Acceptance of your order
  • An order placed by you for goods is an offer to buy the goods and is not binding on either you or NiNight until NiNight has confirmed its acceptance of your order. If your order is accepted NiNight will send you an order confirmation and a contract will be formed at the time at which NiNight e-mails/faxes/posts confirmation to you that your order has been accepted and is being processed (whether or not you receive such e-mail, fax, or letter).
  • When you order goods from NiNight there is no guarantee that your order will be accepted. NiNight may no longer have the goods requested in stock. In this situation NiNight will notify you that your order has not been accepted. Until your order is accepted you will have no right to the goods which you have ordered.
  • We shall be entitled to cancel the contract or suspend delivery if we are unable to obtain payment.
Refunds & Returns & Cancellation policy If you are not entirely delighted with the goods you have chosen, please ensure you return them to us within 28 days. We will be more than happy to make an exchange or refund of the goods providing they are returned in perfect condition and in their original packaging.

We cannot accept items for a refund or exchange if they have been damaged in the wash.

In the unlikely event of your goods arriving in a damaged or faulty condition we will replace your goods or issue a refund if you prefer - please let us know straight away.  Refund of postage and shipping costs will only be given in this event, or in the event you are erroneously sent the wrong product

In order to return goods to us:

  • Write on the reverse side of the invoice, (which comes with the order) whether you would like a refund or exchange.
  • Pack the items back in the parcel, attach the invoice and send it back to NiNight! at the address given on the invoice:

If you are returning the goods for any reason other than damage to or a defect in the goods, you must pay the cost of return of the goods and you will be responsible for their safety during transportation. When returning items we strongly recommend you obtain a free receipt of postage from the Post Office as proof of postage, as we will not accept responsibility for parcels lost in transit. If you do not return the goods to NiNight, we shall be entitled to deduct the cost of recovering the goods from the sums we refund to you as set out below. 

In order that we may improve our service to their customers, you are requested to send a statement explaining your reason for rejecting the goods, although you do not need to do so if you do not want to.

Under UK law, you are also entitled to a "cooling off" period after placing your order. You may cancel your order without giving a reason and return your goods within seven days following the day of receipt for a full refund of all charges other than postage. Refunds are processed within 30 days of notice of cancellation.

Please notify us by email or telephone of your intention to cancel.

The goods must be returned to NiNight in their original packaging and in perfect condition.

NiNights extra guarantees are in addition to your statutory rights as a consumer.

Delivery

    All orders are delivered via Royal Mail , with the following expected delivery dates
    (postage rates are based on actual cost of Post and Packing)

    UK 1 -2 items 1st Class Recorded Delivery
      3 or more items Royal Mail Parcel Service (approx 3 working days) and packages over 2kg in weight
    Rest of the World all items Royal Mail Parcel Service (time taken differs dependant on country, and you will be advised by us in your confirmation email)
    BFPO   if sending to a BFPO address, please select UK as the destination country
  • Postage is based upon the total weight of the order.

Our secure web pages are being hosted by SecureHosting Ltd., who use 128bit SSL to ensure secure transmission of your information. This is to encrypt all data as it is transferred over the Internet.

The secure servers are situated on a standalone private network completely isolated from other networks and connections. They have a single resilient connection to the Internet, which is serviced through dual dedicated ICSA compliant firewalls. The servers are further secured through "server lock" protection, with all credit card details encrypted through 3DES Encryption.
 

The cardholder is further protected:

Card issuers protect cardholders from fraudulent use of their card in a "card not present" environment, such as over the Internet or telephone. As the shopper did not sign for the goods they have the absolute right to demand a chargeback if those goods did not arrive or the card was used fraudulently.
 

Complaints We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise. If you have a complaint contact us at complaints@ninight.co.uk or at our postal address as previously provided above. We aim to acknowledge all complaints within 5 working days and try to resolve complaints within a further 10 days of acknowledging the complaint. We will keep you informed of progress.
